Auckland Creative is a trading name of Kraig Phillips. When this policy says "we", "us" or "our", it means Auckland Creative. Kraig is the privacy officer for the business, so any privacy question comes straight to him.

The short version

What we collect, and why

The enquiry form on aucklandcreative.co.nz

What you give us Why we ask
Your name So we know who we're talking to
Your email address So we can reply
Your business name So we can look at your business before we talk
What your customers come for It's the starting point for the first screen of your site
Your deadline So we can tell you honestly whether we can meet it
Whether you have a brand (logo, colours, guidelines) So we know where the design starts
Your message Anything else you want us to know
Your IP address and the page you sent it from (recorded automatically) To stop the form being used for spam or abuse

Your name, email address and business name are needed to send the form; everything else is optional. If you'd rather not use the form, email us at hello@aucklandcreative.co.nz.

When you send the form, you get one automatic email confirming we have it. It doesn't repeat what you wrote, and you aren't added to any list.

The email showcase (send-a-sample form)

What's collected Why
Your email address To send the sample emails you picked
Which designs you picked So the right emails are sent
A send log: the time, your email address, the designs and your IP address To limit sends (3 per inbox per day, 10 per IP address per hour) and stop the form being used to spam people
Your email address on an opt-out list, if you use the opt-out link So you never get another sample, even if someone types your address in again

Each sample email says who sent it and why, and has a one-click opt-out link. Asking for a sample does not put you on a mailing list.

We won't contact you about anything else because you requested a sample.

If we switch on a bot check for the forms, it will be Cloudflare Turnstile, which sees your IP address and some browser details to check you're a person. This page will say so when it's on.

Analytics

We use Google Analytics to count visits, see which pages are read, and count clicks on "Start your site", the enquiry form and the example sites. It only runs if you choose "Accept" on the banner at the bottom of the page. If you choose "No thanks", no analytics cookies are set and nothing is sent to Google.

When it runs, Google Analytics sets cookies and sends Google (Google LLC, in the United States) details such as the pages you view, your approximate location, your device and browser, and how you arrived. Google may use this data under its own terms. Google is in the United States and may not protect information the way New Zealand law does. That's why Analytics only runs if you say yes. You can change your mind at any time with the "Cookie settings" link in the footer, or block it everywhere with Google's opt-out browser add-on (tools.google.com/dlpage/gaoptout).

If you become a client

If we work together we also keep the details needed to run the job and bill you: your contact details, your business details, the proposal and terms you accepted, invoices and payments, and the content you send for your site.

Where it's stored

Apart from Google Analytics (see above), these providers only store or send it for us and don't use it for their own purposes. They store it outside New Zealand. When a provider only stores or processes information on our behalf, the Privacy Act treats us as still holding it (section 11), so we stay responsible for it and choose providers that protect it.

How long we keep it

Information How long
Enquiries that don't turn into work 12 months, then deleted
Showcase send log (email, designs, IP address) 30 days, then deleted
Showcase opt-out list For as long as the showcase runs, so the opt-out keeps working
Client records, invoices and payments 7 years, because New Zealand tax law requires business records to be kept that long

The showcase's send limits are held in memory and clear whenever the server restarts.

Who sees it

Only us, plus Google Analytics if you said yes, and the service providers listed above, as far as they need to for their part. We don't sell or rent your information, and we don't share it with anyone else unless the law requires it.

Keeping it safe

We use providers with encrypted connections (HTTPS), keep logins protected with strong passwords and two-factor sign-in where it's offered, and keep only what we need. If a privacy breach ever happened that could cause you serious harm, we would tell you and the Privacy Commissioner, as the Privacy Act requires.

Your rights

Under the Privacy Act 2020 you can:

Email hello@aucklandcreative.co.nz. We'll reply within 20 working days, which is the time the Act allows, and usually much sooner. It's free.

Complaints

If you're unhappy with how we've handled your information, tell us first and we'll try to put it right. If that doesn't resolve it, you can complain to the Office of the Privacy Commissioner:
